其次，我认为根据已知事实，过程中的转帐行为没有非法之处；
三，结果是平安付方损失了过千万元，我认为主要责任应由平安保险承担，当事人从中获得的利益我认为是不当得利，应归还平安付，属于民事案件
四，该案刑事判刑的依据是通过当事人的动机和后果及以此认定的转帐不合法，我认为不妥当
最后，我认为通过动机来判定转帐的合法性是非常危险和错误的
